The high demands you place on BMW products and services, as well as the customer care we provide as a BMW partner, are our guiding principles for handling your data. Our aim is to create and maintain the basis for a trusting business relationship with our customers and interested parties. The confidentiality and integrity of your personal data is of particular concern to us. We will therefore process and use your data carefully, for the intended purpose or in accordance with your consent and in accordance with the statutory provisions on data protection.
In the following sections, this data protection notice describes how we, the Euler Group as a BMW partner, collect, process and use personal data from customers and interested parties.

Who is the competent body for data processing operations?
Autohaus Euler GmbH (hereinafter referred to as "Autohaus Euler", "Euler Group" or "We"), Karl-von-Drais-Str. 6-9, 60435 Frankfurt, Germany, represented by the Managing Director Cyril von Recum, is the controller within the meaning of the EU General Data Protection Regulation ("GDPR") for the processing of your personal data. Autohaus Euler has its registered office in Frankfurt am Main. As an authorized BMW dealer, BMW i agent and BMW i authorized workshop, we are an authorized BMW and BMW i partner and a legally and economically independent company and not part of BMW AG. As a licensee, we use the BMW and BMW i brand for the sale of BMW and BMW i automobiles, original BMW and BMW i parts and accessories, and for brand-related maintenance and repair. We are the data controller for your data that is collected and processed by us via this website, through your contacts with us at the dealership and in the context of customer support as well as in the context of our direct marketing activities. Furthermore, we process your data if it is transmitted to us by BMW AG, if and to the extent that the necessary data protection requirements are met. When do we collect and process personal data?
We collect and process your personal data in the following cases, among others:
- If you contact us directly, for example through this website or at the dealership.
- If you buy products directly from us (e.g. vehicles or parts and accessories).
- When you buy services directly from us (e.g. when your vehicle is serviced or repaired).
- When you request information about our products and services (e.g. sending brochures or price lists).
- When you respond to our direct marketing activities, such as when you fill out a response or sweepstakes card or when you submit your information online at this website.
- If BMW AG permissibly provides us with data about you, if and to the extent that the necessary data protection requirements are met.
- If third parties permissibly provide us with personal data about you.
Please help us keep your information up to date by notifying us of any changes to your personal information - especially your contact information.
What data can be collected about you?
The following categories of personal data may be collected through the many services and contact channels described in this Privacy Notice:
- Contact information: Name, address, telephone number, e-mail address.
- Interests: Information you provide about your areas of interest, such as the vehicles you are interested in, hobbies, and other personal preferences.
- Other personal data: Information provided by you regarding date of birth, education, household size or professional situation.
- Contract data: Customer number, contract number.
- Website usage and communications: Information about how you use the website and whether you open or forward communications from us, including data collected via cookies and other tracking technologies. For more information, please see our Cookie Policy: Cookies are used on our website for anonymous, statistical analysis for the duration of a session. A cookie is a small text file that is placed on your hard drive by a website. Cookies do not cause any damage to your computer and do not contain viruses. The cookies on our website do not collect any personal data about you. You can deactivate the use of cookies at any time via your browser settings. You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. By using this website, you consent to the processing of data about you in the manner and for the purposes set out above.
- Creditworthiness and identity information: Data to establish your identity, e.g. driver's licenses or registration certificate part 1; also information on transactions, any payments not made to us; plus information on cases of fraud, criminal acts, suspicious transactions, politically exposed persons and sanctions lists in which your data is included.
- Information on vehicle functions and settings: Information about the functions and current settings of your vehicle (identified by the vehicle identification number), e.g. BMW TeleServices, if you have entered us in the system as the desired BMW partner.
- Technical data on the vehicle: Data that is generated or processed in the vehicle. Operating data in the vehicle: Control units process data to operate the vehicle. This includes, for example:
- Vehicle status information (e.g., speed, motion deceleration, lateral acceleration, wheel RPM, seat belt closed indicator),
- ambient conditions (e.g. temperature, rain sensor, distance sensor). As a rule, this data is volatile and is not stored beyond the operating time and is only processed in the vehicle itself. Control units often contain data memories (including the vehicle key). These are used to temporarily or permanently document information about vehicle condition, component stress, maintenance requirements, and technical events and faults. The data stored depends on the technical equipment: - Betriebszustände von Systemkomponenten (z. B. Füllstände, Reifendruck, Batteriestatus),
- Malfunctions and defects in important system components (e.g. lights, brakes),
- Reactions of the systems in special driving situations (e.g. deployment of an airbag, onset of the stability control systems),
- Information on vehicle damaging events,
- for electric vehicles, state of charge of the high-voltage battery, estimated range.
In special cases (e.g. when the vehicle has detected a malfunction), it may be necessary to store data that would actually only be volatile.
If you make use of services (e.g. repair services, maintenance work), the stored operating data can be read out and used together with the vehicle identification number if necessary. The data may be read out from the vehicle by our employees or third parties (e.g. breakdown services). The same applies to warranty cases and quality assurance measures.
The data is usually read out via the legally required connection for OBD ("on-board diagnostics") in the vehicle. The operating data read out documents technical conditions of the vehicle or individual components, assists in fault diagnosis, compliance with warranty obligations and quality improvement.This data, in particular information on component stress, technical events, operating errors and other faults, is transmitted to BMW AG for this purpose together with the vehicle identification number, if applicable. In addition, BMW AG is subject to product liability. BMW AG also uses operating data from vehicles for this purpose, such as for recall campaigns. This data may also be used to verify customer claims for warranty and rectification.
Fault memories in the vehicle can be reset by a service company as part of repair or service work or at your request.
For further information on the processing of data in the vehicle, please refer to the operating instructions for your vehicle or the BMW AG data protection information (https://www.bmw.de/datenschutz).
- Vehicle location data: information about the location of your vehicle or mobile device. We may receive limited vehicle location data to the extent necessary for the performance of a contract (e.g., as part of BMW Mobile Service roadside assistance).
- Contact form: If you send us inquiries via contact form, your data from the inquiry form, including the contact data you provided there, will be stored by us for the purpose of processing the inquiry and in case of follow-up questions. We do not pass on this data without your consent. The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on our legitimate interest in the effective processing of the requests addressed to us (Art. 6 (1) (f) DSGVO) or on your consent (Art. 6 (1) (a) DSGVO) if this has been requested. The data you entered in the contact form will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions - in particular retention periods - remain unaffected.
- Inquiry by e-mail, telephone or fax: If you contact us by e-mail, telephone or fax, your inquiry including all resulting personal data (name, inquiry) will be stored and processed by us for the purpose of processing your request. We do not pass on this data without your consent. The processing of this data is based on Art. 6 (1) lit. b DSGVO, if your request is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, the processing is based on your consent (Art. 6 (1) (a) DSGVO) and/or on our legitimate interests (Art. 6 (1) (f) DSGVO), as we have a legitimate interest in the effective processing of requests addressed to us. The data you send to us via contact requests will remain with us until you request us to delete it, revoke your consent to store it, or the purpose for storing the data no longer applies (e.g. after we have completed processing your request). Mandatory legal provisions - in particular legal retention periods - remain unaffected.
- Newsletter data: If you would like to receive the newsletter offered on the website, we require an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and that you agree to receive the newsletter. Further data is not collected or only on a voluntary basis. We use this data exclusively for sending the requested information and do not pass it on to third parties. The processing of the data entered in the newsletter registration form is based exclusively on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke your consent to the storage of the data, the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter. The legality of the data processing operations already carried out remains unaffected by the revocation. Legal basis The data processing is based on your consent (Art. 6 para. 1 lit. a DSGVO). You can revoke this consent at any time. The legality of the data processing operations already carried out remains unaffected by the revocation. Storage period The data you have provided to us for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe from the newsletter. Data that has been stored by us for other purposes remains unaffected by this. After you have unsubscribed from the newsletter distribution list, your e-mail address may be stored by us or the newsletter service provider in a blacklist to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves both your interest and our interest in complying with legal requirements when sending newsletters (legitimate interest within the meaning of Art. 6 (1) lit. f DSGVO). The storage in the blacklist is not limited in time. You can object to the storage if your interests outweigh our legitimate interest.
CleverReach
This website uses CleverReach to send newsletters. The provider is CleverReach GmbH & Co. KG, Mühlenstr. 43, 26180 Rastede. CleverReach is a service with which the newsletter dispatch can be organized and analyzed. The data you enter for the purpose of receiving newsletters (e.g. e-mail address) is stored on CleverReach's servers in Germany or Ireland. Our newsletters sent with CleverReach allow us to analyze the behavior of newsletter recipients. Among other things, we can analyze how many recipients have opened the newsletter message and how often which link in the newsletter was clicked. With the help of so-called conversion tracking, it can also be analyzed whether a predefined action (e.g. purchase of a product on this website) has taken place after clicking on the link in the newsletter. The data you provide for the purpose of receiving the newsletter will be stored by us or the newsletter service provider until you unsubscribe from the newsletter and will be deleted from the newsletter distribution list after you unsubscribe. Data that has been stored by us for other purposes remains unaffected by this. For what purposes is your data processed?
The data collected in connection with the conclusion of contracts or the provision of our services are processed for the purposes stated below. First of all, here is an explanation of the legal basis for the processing of personal data:
We will only process your data if an applicable legal provision allows us to do so. In particular, we will process your data on the basis of Art. 6 and Art. 9 of the DSGVO and on the basis of consent pursuant to Art. 7 DSGVO. In doing so, we will base the processing of your data on the following legal bases, among others. Please note that this is not a complete or exhaustive list of legal bases, but these are merely examples that are intended to make the legal bases more transparent.
- Consent (Art. 6 para. 1 p. 1 lit. a), Art. 7 DSGVO, respectively Art. 9 para. 2 lit. a), Art. 7 DSGVO): We will only process certain data on the basis of your previously given explicit and voluntary consent. You have the right to revoke your consent at any time with effect for the future.
- Fulfillment of a contract / pre-contractual measures (Art. 6 para. 1 p. 1 lit. b) DSGVO): To initiate or execute your contract with us, we need access to certain data.
- Fulfillment of a legal obligation (Art. 6 para. 1 p. 1 lit. c) DSGVO): We are subject to a number of legal requirements. In order to fulfill these requirements, we must process certain data.
- Safeguarding legitimate interests (Art. 6 para. 1 p. 1 lit. f) DSGVO): We will process certain data to protect our interests or the interests of third parties. However, this only applies if your interests are not overridden in the individual case.
A. Fulfillment of the contractual obligation within the scope of distribution, maintenance and repair of vehicles
(Art. 6 Abs. 1 lit. b) DSGVO)
We collect, process and use personal data as part of the sales process or during maintenance or repair at our dealership.
As part of the sales process, personal data is used by us to process the purchase contract, to conduct test drives and to transmit information in connection with your vehicle purchase.
Within the scope of these activities, the following categories of data are processed:
- Contact details (surname, first name, address, e-mail address, etc.)
- Bank details, if applicable
We use your personal data to contact you in the course of contract processing (e.g. vehicle order, workshop/repair order) or for processing a request formulated by you (e.g. quotation, test drive request). For all aspects of contract processing or the processing of a request, we will contact you without separate consent, e.g. in writing, by telephone, via messenger services, by e-mail, depending on the contact data you have provided.
As part of the maintenance and repair processes or services at our company, vehicle technical data relevant to vehicle service is read out from the installed electronic control units using special diagnostic equipment. This data is processed and used in the workshop by trained technicians to diagnose and rectify any malfunctions. This technical data on the vehicle essentially consists of
- Vehicle master data (e.g. vehicle identification number, vehicle type, production date, vehicle equipment),
- Fahrzeugzustandsdaten (Messwerte wie z. B. Kilometerstand),
- Error memory entries (e.g. malfunction of direction indicator),
- load collectives, - software states as well as
- service and workshop data (e.g. service requirements, work performed, spare parts installed, warranty cases, workshop logs).
The foregoing information may be accessed by BMW AG to assist us with technical or other challenges to our performance.
The technical vehicle data is deleted at the end of the vehicle's life cycle.
We may also receive limited data for locating the vehicle if this is necessary for the purpose of fulfilling a contract (e.g. as part of the MINI Mobile Service roadside assistance). We use the data exclusively for the purpose of fulfilling the contract.
B. Fulfillment of our sales, service and administrative processes in cooperation with BMW AG
(Art. 6 Abs.1 lit. a, b, f) DSGVO)
For the fulfillment of sales, service and administrative processes, a transfer of data to BMW AG is necessary. This is the case when we transmit data
- for the examination of warranty/guarantee cases
- for the processing of vehicle orders and services
- for questions about specific repair implementation
- on marketing campaigns or market research
- for the execution of contractual agreements between us and BMW AG
- to maintain product liability and product observations for possible recalls
- for product and quality improvement For these processes, depending on the relevant
legal basis the following categories of data are transmitted:
- Contact details
- Identification data
- Vehicle master data
- Vehicle condition data
- Error memory entries
- Service and workshop data
C. Customer service
(Art. 6 Abs. 1 lit. b, f) DSGVO )
We use your personal data to contact you in the course of processing the contract (see above). (e.g. vehicle order, workshop/repair order) or for processing a request formulated by you (e.g. quotation, test drive requests, inquiries and complaints). For all aspects of contract processing or the handling of a request, we will contact you without separate consent, e.g. in writing, by telephone, via messenger services, by e-mail, depending on the contact data you have provided.
We will also contact you if your vehicle is affected by a so-called Technical Action or a recall. Since Technical Actions are usually measures of high importance (e.g. avoidance of danger to passengers, avoidance of damage to the vehicle), we will contact you or BMW AG using the contact data you have provided.
We also process your personal data on this basis to further optimize your experience with us, e.g. to clearly identify you when you contact us.
D. Promotional communication and market research based on consent
(Art. 6 Abs. 1 lit. a) DSGVO )
If you have separately given your consent to further use of your personal data, your personal data may be used in accordance with the scope described in the consent, for example for advertising purposes (selected offers for products and services) and/or market research, and may be passed on to affiliated companies of Auohaus Euler (see also imprint) and BMW AG (Bayerische Motoren Werke Aktiengesellschaft, Petuelring 130, 80788 Munich). Details of this can be found in the respective declaration of consent, which can be revoked by you at any time.
When you select the corresponding consent in promotional communication, we collect and process:
- Contact information, e.g. name, address, email, phone number
- Supplemental personal information / preferences, e.g.:
- Company name, your relationship to that company, if you use a company vehicle or are our contact for that company
- A possible time when you need a new vehicle and your interest in MINI vehicles and services, as well as your requests of information and test drives, etc..
- Vehicle identification number and other attributes linked to it
- Interests and hobbies
- Status of your privacy consent statement and selected or preferred communication channel
- Identification data, e.g. customer number, contract number
- Customer history, e.g.
- Vehicle purchase data incl. model, configurations, purchase date, registration date, license plate number, order date, delivery date, owner, list price.
- Service order data incl. scope of activities performed and spare parts installed
- Campaign history and response to direct marketing activities
- Participation in events
- Request and complaint history
In the data protection consent form, you also specify the communication channels (e.g. mail, telephone, e-mail) on which we may contact you.
As a rule, data processing for advertising purposes takes place in Germany; under no circumstances will personal data be transferred to a country outside the EU.
E. Compliance with legal obligations to which we are subject
(Art. 6 Abs. 1 lit. c, f) DSGVO)
We will also process personal data if there is a legal obligation to do so. Collected data is also processed in the context of ensuring the operation of IT systems. Securing is understood to include the following activities:
- Backup and recovery of data processed in IT systems,
- Logging and monitoring of transactions to verify correct functioning of IT systems,
- Detection and defense against unauthorized access to personal data,
- Incident and Problem Management to troubleshoot IT systems.
We are subject to a variety of other legal obligations. In order to comply with these obligations, we process your data to the extent required and, if necessary, pass it on to the responsible authorities within the scope of statutory reporting obligations.
Furthermore, we may process your data in the event of a legal dispute if the legal dispute makes it necessary to process your data.

F. Data transfer to selected third parties
1. Data will be forwarded to the following companies, among others, if and to the extent that the necessary data protection requirements are met:
- If you have previously given us your express consent to share your data with affiliated companies in our group of companies for advertising or marketing purposes.
- To BMW AG, e.g. to update your address and vehicle, if and to the extent that the data protection requirements necessary for this are met and you have not objected to the use of your data for the purpose of written communication in the knowledge of a right to object, as well as contact details and personal data (e.g. date of birth, driver's license class, hobbies and interests), if your consent to advertising purposes permits this, or also vehicle data used by BMW AG, in particular for the purpose of product monitoring and development.
- To carefully selected and vetted service providers and business partners with whom we work to provide products and services to you. We do this only within the strict requirements of data processing on behalf or on the basis of your explicit consent.
- To other third parties (e.g. public authorities) insofar as we are legally obliged to do so.
2. Integration of third-party services and content
Within our online offer, we use content or service offers of third-party providers on the basis of our legitimate interests (i.e. interest in the analysis, optimization and economic operation of our online offer within the meaning of Art. 6 para. 1 lit. f) DSGVO) in order to integrate their content and services, such as videos or fonts (hereinafter uniformly referred to as "content"). This always requires that the third-party providers of this content are aware of the IP address of the user, since without the IP address they could not send the content to their browser. The IP address is thus required for the display of this content. We endeavor to use only such content whose respective providers use the IP address only for the delivery of the content. Third-party providers may also use so-called pixel tags (invisible graphics, also known as "web beacons") for statistical or marketing purposes. The "pixel tags" can be used to evaluate information such as visitor traffic on the pages of this website. The pseudonymous information may also be stored in cookies on the user's device and may contain, among other things, technical information about the browser and operating system, referring websites, time of visit and other information about the use of our online offer, as well as be linked to such information from other sources. The following presentation provides an overview of third-party providers and their content, along with links to their privacy statements, which contain further information on the processing of data and, in part already mentioned here, opt-out options:
2.1 On the store.swp.de website, we use Smartsupp Live Chat to allow you to contact us directly. The Smartsupp Live Chat is developed and distributed by Smartsupp.com s.r.o., Milady Horakove 13, 602 00 Brno, Czech Republic. When you use this contact option, some data is transferred to Smartsupp.com s.r.o.. This includes, among others, IP address, type and version of browser, type and version of operating system, estimated access location. Messages sent via this online support chat are also stored on the servers of Smartsupp.com s.r.o.. For more information, see the Smartsupp c.r.o privacy policy at www.smartsupp.com.
Wie schützen wir Ihre personenbezogenen Daten?
We employ various security measures, such as state-of-the-art encryption and authentication tools, to protect and maintain the security, integrity, and availability of your data.
One hundred percent protection against unauthorized access cannot be guaranteed for data transmissions over the Internet or a website, but we and our service providers and business partners use our best efforts to protect your personal data in accordance with applicable data protection laws using state-of-the-art physical, electronic and procedural safeguards. Among other things, we employ the following measures:
- Strict criteria for authorization to access your data according to the "need-to-know principle" (restriction to as few people as possible) and exclusively for the specified purpose,
- Disclosure of collected data exclusively in encrypted form, storage of confidential data, e.g., credit card data exclusively in encrypted form, firewall protection of IT systems to protect against unauthorized access, e.g., by hackers, and permanent monitoring of access to IT systems to detect and prevent misuse of personal data.
How long do we keep your data?
We will retain your data in accordance with Art. 17 GDPR only for as long as is necessary for the respective relevant purposes for which we process your data. If we process data for multiple purposes, it will be automatically deleted or stored in a format that does not allow direct conclusions to be drawn about you as soon as the last specific purpose has been fulfilled. To ensure that all your data is deleted again in accordance with the principle of data minimization and Art. 17 DSGVO, we have a deletion concept. The basic principles according to which this deletion concept provides for the deletion of your personal data are outlined below.
Use for the performance of a contract
To fulfill contractual obligations, data collected from you may be retained for as long as the contract is in effect and, depending on the nature and scope of the contract, 6 or 10 years beyond that to comply with legal retention requirements and to address any inquiries or claims after the contract expires.
In addition, there are contracts for the supply of products and services that make longer retention periods necessary, see also "Use to verify claims" below.
Use for testing claims
Data that, in our judgment, will be necessary to investigate, defend against, or bring a criminal prosecution or claim against you, us or a third party may be retained by us for as long as any such proceeding might be brought.
Use for customer service and marketing purposes
For customer service and marketing purposes, the data collected from you may be retained for 3 to 10 years after collection, unless you request deletion of this data and there are no contractual or legal retention obligations that conflict with this deletion request.
